Demur (or demurrer) refers to making a pleading that challenges the sufficiency or adequacy of pleadings of another party. Demurrers typically come in two forms: general and specific.

  • A general demurrer challenges a broader problem with a pleading that affects all of the claims brought, such as improper venue.
  • A specific demurrer objects to a particular problem with the details of a pleading, most commonly the failure to claim sufficient facts for a cause of action.
In ruling on a demurrer, a court accepts the factual assertions of the moving party as true. A demurrer does not challenge the truthfulness of facts in a pleading. If a demurrer is granted by the court, the case may be dismissed or the moving party may be given time to amend the pleading depending on the circumstances.
The crux of this is Trump's original pleading in reply to the prosecution was based on supposed factual statements. Since the original pleading, it's been shown that those statements were bullshit. Trump wants the court to allow them to replead to the correct set of facts or have the court simply dismiss the case.

The court is in DC so I expect the case to not be dismissed and the court rejects Trump's demur request.

Al Green kept hidden till Mayorkas Vote​

Republicans knew the number of people voting in the House yesterday. Knew they had a 1 vote margin on the impeachment vote. There was a previous bill voted on that was 427 - 2. So 429 members at the house for the Mayorkas vote. So they bring forth the impeachment vote and boom, here comes Al Green in a wheelchair and hospital gown at the last minute to tie the vote.
The Dems are scum and play dirty for sure.

Application for Stay as if it is a Cert Petition, and agree to either take up the case or not take up the case.

That will accelerate the timeline for getting the case back to the District Court for purposes of trial.

It will also put pressure on SCOTUS to hear the case either before the end of the current session in June -- potentially even to set it on a much accelerated time frame over the next 4-6 weeks.

It is really a gamble by Smith and the Court panel that there are now 5 votes on SCOTUS who want to see a Trump trial prior to the Nov. election, and those 5 votes will act to make that happen, i.e., they already plan to deny the immunity claim, so the faster that can happen, the better.

If there are not 5 votes on SCOTUS now, then SCO Smith and the Appeals Court are trying to smoke that out too.

I'm just not convinced there are 5 Justices who want to be drawn into the calendar machinations that the lower court participants want them to engage in. The more defensible position if they want to remain above the fray is simply treat the case as they would any other -- handle it all with normal scheduling.

PUTIN: (laughs) I don’t know if this should be taken seriously, but Russian ideals have support. We believe in traditional values; marriage is between a man and a woman: men are men and women are women.
TUCKER: Who would you like to see as the next President of the United States?
PUTIN: Again, it is not for us to say this or to get involved. Contrary to long-standing accusations, we do not meddle in your elections. We don’t need it, because it’s the same people who end up running things anyway.

TUCKER: Is that why you defend the BRICS?
PUTIN: The BRICS would exist anyway. This is a natural reaction to the Western trading bloc. It’s a counterweight. When the dollar is used as a weapon against the states, there will be a natural alternative. That’s what we want.

PUTIN: That would be a bit strange and out of place, but we are well prepared. He promised to end the fighting in Ukraine and we support this idea.
TUCKER: How could he end the war so quickly?
PUTIN: On the one hand, he never insulted us. He has great respect for Russia. We would start from a position of friendship and trust – then all problems can be solved. We could do it. Trust me.
TUCKER: Are you referring to Biden calling you a killer?

was the fear that concern for later civil lawsuits/liability could impact POTUS decision-making on controversial issues. The unique nature of the office was a significant part of factoring in that concern.That was an issue raised by Trump. If Obama thought "I could get indicted for murder if I do this," would he still have ordered the drone strike on a US citizen abroad?" In yesterday's opinion the DC Court panel just waved this issue off with very little meaningful consideration. It is a problem and they did not have a meaningful response -- not one that came close to distinguishing why that issue was a fundamental part of Nixon, but not one that was of significant consequence here. I believe that 4 Justices of the Supreme Court will want that issue explored much further than was done by the Appeals Court. There may not be a 5th vote to be had.But it only takes 4 votes to accept Cert. I also suspect that Trump will file for en banc review. I'm almost certain the full court will not vote to take the case en banc, but I think you will see a dissenting opinion from that decision issued by the three Trump appointees on the Court that will, in effect, frame both sides for SCOTUS ahead of a decision whether to grant Cert.

I think when he returned to the room where he found it, everything was gone. I think he said angels moved them.
I believe he found the actual Ark. His drawing had the angels wings on the mercy seat different from any picture or drawing I've seen. The mercy seat is the actual throne Christ will rule from in the millennial. His drawing had the wings situated like a chair.

Hit them in the pocketbook. It's the only thing that gets their attention. Eventually their insurance company will object to paying judgments or they will jack their premiums/cancel the policy. Either way it becomes quite costly. Notice the WaPo has apparently learned after paying millions.
