I think they may consider recess appointments either way. From what I can tell, there are between 1200-1400 positions that need to be confirmed by the senate. That's a lot of people. So how many of those confirmations will be done daily? Trump said it could take up to 2 years to get all of the confirmations through, so if the Senate is dragging their feet and not getting enough people through, that will delay everything.

So if they can figure out a way to make the recess appointments work, if would be a 10 day break and then push through all of the appointments. At least that's my understanding of it.

Genuinely curious why everyone thinks these recess appointments will work and not be met with legal challenges. Is the idea to appoint the whole cabinet and overwhelm the possibility of legal challenges? SCOTUS has ruled that recess appointments for short recesses are unconstitutional. It seems like most people think this will just work....help me out here.

The recess has to be more than ten days

more than three days but less than ten days is presumptively too short to trigger the President’s appointment power under the Clause.
