I don't disagree, but at that point it was a moral and philosophical argument. Not a legal one. His speech was in 1814. After the 13th amendment following the Civil War, it became unconstitutional, although most would admit it was an unintended effect of the amendment.
The workaround is that we don't have true involuntary conscription. The SSA provision making failure to register a felony is highly problematic, but until it's enforced, SCOTUS won't grant standing to challenge it. (One of many insanely ridiculous traps introduced by Justice Brandeis to prevent citizens from challenging unconstitutional laws BEFORE their damaging effects take place) And since the Constution specifically allows for severability (removing the unconstitutional portions of an act or order, while letting the rest stand, as long as the rest can stand on its own), the SSA itself is probably constitutional. But providing benefits in return for service or volunteering for potential drafting is not only constitutional, but expected compensation in return for service. So tying privileges , not rights, to registration, is valid.
This practice was common even during the Revolutionary War when slaves were freed from their indentitude in return for military service.
I would argue that the felony provision of the SSA gives a reasonable person the impression that it is mandatory, and their "volunteerism" for selective service is not a valid contract, since it's made under false pretenses. And while ignorance of the law is not a defense, I would argue that it is impossible to be ignorant of unsettled law, for if one can be ignorant of unsettled law, then there is no need nor justification for a judiciary. But, this makes me think @Goldhedge 's claim about stepping forward has at least a strong basis in fact. The history of stepping forward or crossing the line to indicate voluntary service is well established in common law.
