• Pat Flood (@rebarcock) passed away 9/21/25. Pat played a huge role in encouraging the devolopmemt of this site and donated the very first dollar to get it started. Check the thread at the top of the board for the obituary and please feel free to pay your respects there. I am going to get all the content from that thread over to his family so they can see how many people really cared for Pat outside of what they ever knew. Pat loved to tell stories and always wanted everyone else to tell stories. I think a great way we can honor Pat is to tell a story in his thread (also pinned at the top of the board).

Outstanding if true. Until those that are getting hosed from jobs because of the color of their skin or their gender start taking on these discriminatory practices, it will continue to go on.

I suspect lots of hospitals and other businesses, foundations, colleges, associations, et al, will be receiving similar judgements in the near future. The Jab will be the culprit.

If you separate those Jabbed and those not, that is discrimination and a violation of several amendments. If you make people wear a label for not being jabbed, that too is discrimination. Or any of the other nitwit discriminatory ideas the Jabbers are pushing.

You and I might feel that way but the DOJ and lower courts & SCOTUS don’t (SCOTUS could change this but hasn’t in the recent rulings and there is precedent again it).

Equal Opportunity practices and Civil Rights Act of 1964 prohibits discriminationon the basis of race, color, religion, sex or national origin but not medical choices.

American with Disability Act doesn’t protect against this either because vaccination status isn’t considered a disability.

It’s shitty but we would need Congress to pass a law prohibiting that specific type of discrimination which isn’t gonna happen even if the GOP is in power or have individual states pass laws.

Puddin would veto such a law and the GOP isn’t gonna have veto proof majorities in the Senate. Also many in the GOP think it’s a business’ choice and well within their right to decide whether to require it or not (see Ohio and Arkansas governors for example).

All true, but what about people with a medical condition that means they cannot be vaccinated? If you have MS and your Dr says do not get vaccinated, and you are fired because of it, weren't you really fired because of a medical disability? You could make that argument.

That’s where a company is supposed to allow for medical exemptions / religious exemptions. Religious exemptions have to be legitimate on many grounds including a recognized religion, basic tenets of that religion, and proof of strict religious participation.

Companies are directed to request documentation from a physician for medical exemption claims. If deemed legitimate they can then decide if they believe the employee can reasonably do the job with accommodation that isn’t detrimental to the company (as per the ADA).

Examples might include requiring an employee to continually wear masks and PPE both during and after the pandemic as has ended.

Employees that are fired for refusing getting the jab aren’t even entitled to unemployment typically. The employers hold nearly all the cards. If a person had a legitimate documented medical exemption and were still fired they might have grounds to sue but it’s not a forgone conclusion especially in certain states. The ADA has big holes as well.

As the expert on Tucker’s show stated it’s really time for the GOP to change its platform from fealty to corporations and businesses to individual liberty which would include individual worker’s rights. A large part of the reason this is even possible was the ground work they laid for decades giving businesses outsized autonomy over their employees.
