Some lawyer will argue the SoL had expired and some judge will accept the argument and rule against the gov't. Even if it's a wrong ruling (we've seen lots of them) it takes additional time to argue that in appeals. Just indict him now and save the time and effort. You can still indict him for RICO etc.

I also think the sealed indictments will be wrapped into a greater RICO/conspiracy case. But if the White Hats have even a modicum of skill, they would not have looked past the SoL.
