Conspiracy Charges: Conspiracies are treated as continuing offenses, allowing venue in any district where an "overt act" in furtherance of the conspiracy occurred-even if minor or committed by a co-conspirator (not necessarily the main defendant). This is a common prosecutorial tool to select a favorable venue.
In Obama's case, if allegations involve a broad "conspiracy to subvert the election," prosecutors could argue an overt act happened in Florida.
For instance:
Trump's 2016 campaign had significant activity in Florida (e.g., rallies, voter outreach, or where alleged "spying" impacts were felt).
Connections to Florida-based individuals or events, like FISA surveillance affecting Trump associates who traveled to or resided in Florida.
A phone call or communication routed through or to Florida could suffice, as courts have upheld venue based on such minimal links (e.g., a cooperator placing a call from the district).
This mirrors how DOJ chose Florida for Trump's classified documents case (due to Mar-a-Lago's location) over D.C., despite some acts occurring elsewhere.
