Congress passed legislation to make the FED an entity. The FED is both private and governmental. (Lot more to that aspect though) but to insure politics would not play a role and decision would be data driven the FED was given autonomy in that they can do as they please with out interference from the executive branch or congress. Congress can act but it would require new legislation.

There are some that make the claim it is part of the government and as the head of all the government is the President and that Congress doesn't have the authority to put an unelected official in a government office and not allow the president authority over that position.
And I think that is a very legitimate position. But I didn't know we were in maritime law either so wtf do I know
