An appeal to the higher U.S. Court of Appeals.

GROK: Can trump appeal an unconstitutional judges order

Yes, Donald Trump, like any other individual or entity, can appeal a judge's order if he believes it to be unconstitutional. Here's how that process generally works:
  1. Filing an Appeal:
    • After a judge issues a ruling that Trump or his legal team believes to be unconstitutional, they would file an appeal with the next higher court. For federal district court rulings, this would generally be the U.S. Court of Appeals for the relevant circuit.
  2. Grounds for Appeal:
    • The appeal would need to be based on legal arguments, including but not limited to:
    • Specifically, if the argument is that the order is unconstitutional, the appeal would focus on how the judge's decision contravenes specific constitutional provisions.
  3. Stay of the Order:
    • Trump might also request a stay of the judge's order pending the appeal. This means asking the court to temporarily suspend the enforcement of the order until the appeal is decided.
  4. Appellate Court Review:
    • The appeals court would review the case, focusing on legal errors rather than re-examining the facts unless those facts were misconstrued by the lower court. They would assess whether the judge's ruling indeed violated constitutional principles.
  5. Possible Outcomes:
    • Affirm: The appeals court could affirm the lower court's decision, finding no error.
    • Reverse: They might reverse the decision if they find it unconstitutional or legally flawed.
    • Remand: The case could be sent back (remanded) to the lower court for further proceedings with instructions or clarifications.
  6. Further Appeals:
    • If the appeal does not result in the desired outcome, the case could be escalated to the U.S. Supreme Court if it involves significant constitutional questions or if there's a division among the federal circuits on the issue. However, the Supreme Court has discretion over which cases it hears.
  7. Legal Representation:
    • Trump would need to be represented by attorneys knowledgeable in appellate law and the specific constitutional issues at play.
  8. Political and Public Context:
    • While the legal process is in motion, there might be significant political and public discourse around the case, especially given Trump's high profile. This could influence public opinion but not directly affect the legal outcome.
It's important to note that the success of an appeal hinges on the legal merits of the case, not merely on the assertion that an order is unconstitutional. The courts will look for substantive legal arguments backed by law, precedent, and constitutional interpretation. If Trump were to pursue such an appeal, it would follow these procedural steps, with each step potentially taking significant time and resources.

He didn't have an illegal using his ssn
Nope. At least his credit cards didn't contact us until the death certificate was recorded. We used one of his credit cards to pay for his funeral. It sort of forced the CC company's hand to reissue the cards in my Mom's name since she had none of her own. What baffles me is why state and local gov'ts don't automatically remove names from the voter rolls (and other places) as soon as a death certificate is filed. Seems like a no brainer.
