Being a private citizen doesn't permit you to libel or slander, or worse, purposely inciting violence (on a twitter account with 1.5 million followers) against another private citizen.

Pat Flood (@rebarcock) passed away 9/21/25. Pat played a huge role in encouraging the devolopmemt of this site and donated the very first dollar to get it started. Check the thread at the top of the board for the obituary and please feel free to pay your respects there. I am going to get all the content from that thread over to his family so they can see how many people really cared for Pat outside of what they ever knew. Pat loved to tell stories and always wanted everyone else to tell stories. I think a great way we can honor Pat is to tell a story in his thread (also pinned at the top of the board).

How about, don't burn stuff, vandalize, loot and destroy businesses, and attack people on the streets. If none of those things happened, there would have been no reason for any escalation.

The way I understand it is essentially he can claim everything he says in office is related to his job as CiC or in the public interest (which is also his job as CiC). The burden would then fall on Kyle’s lawyers to prove it wasn’t related to the public interest or his work as the Chief Executive.
If Kyle wanted to bring suit for what Joe said while he was out of office he would also likely need to wait until after Joe left office to get a verdict (and in some cases even file) because Puddin’s lawyers will claim it distracts him from his duties as CiC.
It’s part of the sovereign immunity doctrine. It’s why Trump could say pretty much anything and the DOJ represented him as opposed to him being able to be sued personally. It’s also what Trump’s lawyers used as his defense for Stormy & the ugly coat room girl.
Kyle’s team could in theory do it, as seen by Jones v. Clinton, but to say it would be anything less than a complete uphill battle would be an understatement.
